Terms and Conditions
These Terms govern access to hcrmedia.net and HCR memberships, subscriptions, content, job listings, applications, learning products and business services.
Effective 3 October 2026. Nothing in these Terms excludes rights that cannot lawfully be excluded.
Access · Conduct · Responsibility
1. Agreement
Acceptance of these Terms
These Terms and Conditions (Terms) form an agreement between HCR Media (HCR, we, us or our) and each person or organisation that visits, creates an account, purchases, subscribes, submits information or otherwise uses our website and related services (you or your).
By using the Services, creating an account, clicking an acceptance control, submitting a form or purchasing a product, you agree to these Terms and the Privacy and Refund Policies. If you act for an organisation, you confirm that you have authority to bind that organisation.
2. Eligibility
You must be able to enter the agreement
You must be legally capable of entering a binding contract. If you are under the age of legal capacity where you live, a parent or guardian must approve your use and purchase. You must comply with laws that apply to your use of the Services.
We may refuse or restrict access where reasonably necessary for safety, legal compliance, fraud prevention, service integrity or protection of HCR and its users.
3. Accounts
Accurate information and secure access
You must provide accurate, current and complete information, keep it updated, protect your login and notify us promptly if you suspect unauthorised access. You are responsible for activity through your account to the extent permitted by law.
Member access is personal unless a product description expressly permits team access. You must not sell, transfer, lend or share account access, subscription benefits, restricted listings or member resources.
4. The Services
What HCR provides
HCR may provide public and member job or project information, learning resources, courses, templates, events, application tools, account features, Talent pathways, business submission tools and related services described on the website.
The specific content, access period, support, deliverables and restrictions for a paid product are those displayed on the relevant product, checkout or proposal at the time of purchase, together with these Terms.
5. Access tiers
Free, Jobs Access, Pro and Elite
HCR may use customer accounts, payment status, subscription records, order data and account tags to control access. Free users receive public access. Jobs Access unlocks designated paid listings. Pro adds designated Pro listings and tools. Elite unlocks all digital job tiers and the complete digital learning library while the relevant subscription is active.
Access only includes features expressly allocated to the purchased tier. Business services, private consulting, live programs or separately priced products are not included unless clearly stated.
6. Prices and payment
Charges shown at checkout apply
Prices are displayed in the currency shown at checkout. Taxes and fees are handled as displayed or required by law. You authorise Shopify and the relevant payment provider to process the purchase and any recurring charges.
You must ensure your payment information is valid. We may suspend paid access after a failed, reversed or disputed payment while the issue is investigated, subject to applicable law.
7. Subscriptions and renewal
Recurring access continues until cancelled
A recurring membership renews at the interval and price disclosed at checkout until cancelled. By purchasing, you authorise recurring charges using the payment method associated with the subscription.
You may cancel future renewal through available account or subscription controls or by contacting HCR. Cancellation normally takes effect at the end of the current paid billing period. Access may continue until then unless the account is suspended for breach, fraud or non-payment.
8. Refunds
The Refund Policy forms part of these Terms
Change-of-mind refunds may be limited after digital content or member access is made available. Cancellation does not ordinarily create a refund for a billing period already started. The Refund Policy explains how requests are reviewed.
Nothing in these Terms or the Refund Policy excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded.
9. No guaranteed outcomes
Access creates possibility, not certainty
HCR does not guarantee any job, project, client, income, profit, selection, response, interview, acceptance, placement, employer relationship, course result, business result or Talent approval. Purchasing only provides the access and features expressly described.
Results depend on factors outside HCR's control, including skill, experience, portfolio, conduct, availability, location, pricing, competition, market conditions, employer decisions and third-party accuracy. Examples, testimonials, estimates and past outcomes are illustrative and are not promises of future performance.
10. Job listings and opportunities
Third parties make their own decisions
Businesses and other submitters are responsible for the accuracy, legality and completeness of their listings and for hiring, payment, contracting, workplace, tax, insurance and safety obligations. HCR may review, format, moderate, reject, correct or remove a submission but does not guarantee that every statement, party or opportunity has been independently verified.
Unless HCR expressly states otherwise, HCR is not the employer, recruiter, agent, representative or contracting party. Any engagement is between the relevant applicant and third party.
11. Applicant responsibilities
Complete your own checks
Before applying, accepting work or sharing sensitive information, applicants should verify identity, scope, rate, payment timing, expenses, intellectual-property terms, usage rights, travel, safety, tax, insurance and contract terms.
You are responsible for information in your application and for having permission to share portfolios, references and client work. Do not submit false credentials, confidential material or content you do not have the right to use.
12. Business submissions
Clear, lawful and accurate briefs
A business submitting an opportunity confirms that it has authority to do so; the role, budget and contact process are genuine; the information is accurate; and the opportunity complies with employment, anti-discrimination, workplace, privacy, intellectual-property and consumer laws.
Submission is free under the current model, but publication is not automatic. HCR may request clarification, edit formatting, decline publication or remove a listing that does not meet the quality standard or creates legal, safety or reputation concerns.
13. HCR Talent
Assessment is selective and subjective
Submitting a Talent application does not guarantee approval, representation, referral or work. HCR may assess suitability using portfolio quality, professionalism, reliability, experience, commercial readiness, availability and current business needs.
Participation in courses or memberships does not buy or guarantee Talent approval. HCR may review eligibility over time and may pause or remove participation where reasonably necessary.
14. Learning content
Education is general, not professional advice
Courses, templates, workshops and resources are for general educational purposes. They are not legal, financial, tax, accounting, employment, insurance, recruitment or other professional advice.
You remain responsible for adapting information to your circumstances and obtaining qualified advice where needed. Completion does not guarantee competence, accreditation, income or a commercial outcome.
15. User content
You keep ownership and grant an operating licence
You retain ownership of original content you submit. You grant HCR a non-exclusive, worldwide, royalty-free licence to host, copy, format, moderate, display and share that content only as reasonably necessary to operate, promote and improve the Services and connect relevant users.
You confirm that your content is accurate and lawful and that you have every permission required to submit it. You must not submit confidential, defamatory, misleading, infringing, discriminatory, malicious or unsafe content.
16. Acceptable use
Use HCR lawfully and professionally
You must not misuse forms, scrape or harvest data, bypass access controls, share restricted content, resell listings, impersonate another person, interfere with security, introduce malicious code, harass or exploit users, submit fraudulent opportunities, or use HCR content or data to build a competing database or service without written permission.
You must not use applicant or employer information for unrelated marketing, discrimination, stalking, identity theft, spam or any purpose outside the relevant opportunity or consent.
17. HCR intellectual property
Access does not transfer ownership
The HCR name, branding, website design, original copy, course content, templates, databases and member resources are owned by or licensed to HCR and protected by applicable law. Purchasing grants a limited, personal, non-exclusive, non-transferable right to use the purchased material for its stated purpose during the access period.
You must not reproduce, publish, distribute, sell, sublicense, upload, teach from or commercially exploit HCR material without written permission, except to the extent permitted by law.
18. Third-party brands and logos
Identification does not mean endorsement
Names, trade marks and logos may appear for identification, editorial, portfolio, example or opportunity-description purposes. Unless expressly confirmed in writing, the relevant owner is not affiliated with, partnered with, sponsoring or endorsing HCR.
Third-party marks remain the property of their respective owners. If you believe material has been used incorrectly, contact HCR with enough detail to investigate.
19. Privacy
Personal information has a limited purpose
Our Privacy Policy explains how personal information is handled. Users who receive applicant, employer or other user information must use it only for the stated opportunity or purpose, keep it secure and comply with applicable privacy law.
20. Service availability and changes
Content and features may evolve
We may add, update, correct, pause or remove listings, content and features; carry out maintenance; and change how Services operate. We do not promise uninterrupted, error-free or permanent availability or a minimum number of opportunities unless expressly stated for a specific product.
If a change materially affects a paid Service, any remedy will be assessed under the product description, Refund Policy and applicable law.
21. Third-party services
External platforms remain independent
The Services may link to or rely on Shopify, payment providers, employer sites, application platforms, social networks and other third parties. Their availability, content, security and conduct are outside HCR's direct control and may be governed by separate terms.
A link or integration does not by itself mean HCR endorses or guarantees the third party.
22. Consumer guarantees
Mandatory rights continue to apply
Our goods and services may come with guarantees, rights and remedies that cannot be excluded under the Australian Consumer Law or other applicable law. Nothing in these Terms excludes, restricts or modifies those rights to the extent doing so would be unlawful.
Where a service has a major failure or another statutory remedy applies, you may be entitled to cancel and obtain a refund for the unused portion or compensation for reduced value, together with other remedies available under law.
23. Liability
Limits apply only where lawful
To the maximum extent permitted by law, HCR is not liable for indirect, consequential, special or punitive loss; loss of profit, revenue, opportunity, data or reputation; or the independent conduct, content, decisions or failures of employers, applicants, providers or other third parties.
Where liability can lawfully be limited, HCR's aggregate liability arising from a paid Service is limited to the amount paid to HCR for that Service during the six months before the event giving rise to the claim. This limitation does not apply where it would unlawfully exclude or restrict a mandatory right or remedy.
24. Suspension and termination
Access may end for serious misuse
We may suspend, restrict or terminate access where we reasonably believe there has been a material breach, fraud, abuse, non-payment, unlawful conduct, security risk or harm to HCR or another person. Where appropriate, we may provide notice and an opportunity to respond.
Terms concerning intellectual property, privacy, payment, disclaimers, liability and disputes continue after termination where their nature requires it.
25. Complaints and disputes
Contact HCR first where practical
Send a clear description of the issue, relevant dates and the order or account involved. Both parties agree to try in good faith to resolve a dispute before formal proceedings where practical.
Nothing in these Terms prevents a person from exercising a lawful right, contacting a regulator, payment provider or consumer agency, or starting proceedings in a court or tribunal with jurisdiction.
26. Governing law
Western Australia and Commonwealth law
These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. Subject to any right to bring a matter elsewhere under applicable law, the courts and tribunals of Western Australia have jurisdiction.
27. General terms
How this agreement operates
If a provision is invalid or unenforceable, it is read down or severed to the minimum extent necessary and the remaining provisions continue. A delay in enforcing a right is not a waiver. Headings are for convenience and do not limit interpretation.
You may not assign or transfer your account or rights without written consent. HCR may transfer its rights and obligations as part of a genuine business restructure or sale, subject to applicable law and continuing protection of customer rights.
28. Changes to these Terms
Updates apply as permitted by law
We may update these Terms when Services, business practices or legal obligations change. The revised version will be published with a new effective date. Material changes will apply prospectively and additional notice will be provided where required.
